Stoughton Police Chief Donna McNamarra on Friday announced the “deeply troubling” results of an 18-month internal affairs investigation.

Robert C Devine was born on June 13, 1972, the son of Mary and Robert. He moved 4 times during his lifetime. He lived in Canton, Massachusetts, in 1987 and moved to Stoughton, Massachusetts, by 1996. He has two brothers and three sisters.

Robert Devine married Lisa Linskey who grew up in Quincy and went to the South Boston Heights Academy. Lisa graduated with a degree in Criminal Justice from Curry College. Robert Devine and Lisa Linskey met when Robert Devine was a Lt Stoughton police and he was her squad leader at the police academy.

1999 Joined the Stoughton Police Department and started volunteering with Explorers Program run by Stoughton PD.

2001-2004 Devine served as school resource officer

2002 Robert Devine was ordered to run the Explorers Program by the Former Chief Cachopa

2003 Robert Devine along with Roger Hardy Opened a Gym at the O’Donnell Middle School. “We started this to give kids something to do,” said Devine. “It’s working out real well.” With permission from the school department, Devine and Hardy open the gymnasium free of charge to teens from 10 a.m. to 2 p.m. on Tuesdays, Wednesdays, and Thursdays. ‘We play basketball, hockey, whatever the kids want,” said De- vine. “It helps us maintain a relationship with the kids.” The program, which opened in mid-July, and scheduled to end Aug. 14

2006 Became a Lieutenant

2008 Robert Devine became the Executive Officer –  Murphy has named Lieutenant Robert Devine as executive officer, because he was one of the officers who cooperated with prosecutors during the original probe. He has been seen as an outsider in a department that largely rallied around Cohen before he went to jail.

2012 Devine served as the acting chief for 2 months When Shastany was at FBI training.

May 2013 – Devine, who was appointed to the deputy police Devine’s wife, Lisa, an officer with the Quincy Police Department, and daughter Makenna helped pin his badge.

He was actively working with and for the youth in town, with programs like the Police Explorers Academy and OASIS (Organizing Against Substance Abuse in Stoughton).

In 1999 Robert Devine became an advisor for Police Explorers and in 2002 Robert Devine was ordered to run the Explorers Program by the Chief Cachopa, a youth initiative under the department. 

Devine invited former Explorers, Matthew Farwell and his twin brother, William, to serve as guest instructors. The Explorers, a co-ed branch of the Boy Scouts, is designed for older teens and often centers on specific fields like law enforcement. Matthew Farwell and his twin brother, William were former Explorers, They joined the same program in September 1997, when  Matthew and William Farwell were 12 years old. Farwell brothers were known to have disciplinary issues while attending school.

Billy has volunteered with the Stoughton Police Explorers program with which he grew up. William Farwell was designated a the rank of Lieutenant within Explorer Program.

He has assisted Stoughton Police Executive Officer Robert Devine with the running of the annual academy, bringing in Army EOD equipment so the kids could try on a bomb suit or drive one of the robots.

On April 12, 2012, Devine said, “All were in the very first Explorers class 11 years ago. It means a lot to have one of the men in our department. They grew up right before my eyes. If we played even a small part in their success, I’m proud of that.” Devine added, “They’ve donated their time as physical and drill instructors, and they also taught an explosives class. They bring in bomb robots, blast jackets and shields. They are very good at what they do.”

Matthew Farwell is hired as a police officer for the Stoughton Police Department. Robert Devine, who is on the hiring board, covers up Matthew’s past involvement in impersonating police officers.

The Stoughton Police Department ran the Explorer program for about 15 years, but could only locate a single one-year agreement with Learning for Life, the Scouting affiliate that oversees the national Explorer program. The Stoughton Explorer program ended in 2016, and the department has not found any agreements with Learning for Life or the Boy Scouts for the other years the program was active.

The Stoughton Police Department ran the Explorer program for about 15 years, but could only locate a single one-year agreement with Learning for Life, the Scouting affiliate that oversees the national Explorer program.

2011-2012

Youth Explorer Program

The Civilian Youth Explorers Program is for motivated teens with a cut off age of 21. It is a ten week, physically and mentally demanding program based loosely on an actual police academy experience. Graduates of the program are eligible for department ride-along during the summer months. The primary purpose is to give the youth of Stoughton and surrounding towns an activity where they are occupied during high risk times of the day and to have non-confrontational interactions with Stoughton Police Officers. The program is geared toward young people with an interest in policing, medical, fire service, military service, or a desire to serve their community.

The Explorers, a co-ed branch of the Boy Scouts, is designed for older teens and often centers on specific fields like law enforcement. While the program existed before Devine became an advisor, it was struggling with low attendance and enthusiasm. To revive interest, Devine surveyed the members, proposing a mock police academy. Initially, the Explorer post had just five participants, but after promoting the academy, the number increased to 14. By 2011, the program was attracting 25 to 30 kids annually. The post met year-round, with the academy running from March to June, two nights a week.

2013 – 2014 Extramarital Affair – Robert Devine and Tiffany Overstreet.

2013 Devine began to have an affair with Tiffany Overstreet.

October of 2014 obtained restraining orders against Overstreet, when he claimed that he and his wife (who is also a cop in a different town) were receiving threatening messages from Overstreet. Allegedly Overstreet send flowers to his wife November of 2014 Overstreet sent naked pictures of her and Devine to his coworkers and their spouses.

December 18, 2014 Easton Police raided Overstreet’s home in Easton in order to seize her computers to prove she was the one sending the naked pictures.

Overstreet was was taken into custody by state police and charged with with three counts of violating harassment prevention orders that were filed against her by Devine and his wife and was released on personal recognizance. The case has been transferred to Dedham District Court. 

Five days after her arrest, Overstreet reported a break-in at her Easton apartment, When Easton police responded they found no sign of forced entry, according to police, but her apartment “was in disarray – dresser drawers were pulled out, couch cushions were thrown on the floor.”

During investigation it was discovered that Devine continued to meet up with Overstreet for sex. He claimed he was only doing so in order to save her life because she would commit suicide if he didn’t continue to plow ahead.

Documents revealed a secret relationship between Devine and Overstreet that began in the fall of 2013 and eventually came to the attention of both his family and the department. Read Here

Devine contacted state police in November after an email containing graphic photos of him and Overstreet was sent to his police co-workers and their spouses, the police report states. Devine’s wife is a police officer in a different community.

The meetings, according to the report, came after Overstreet had threatened to commit suicide if Devine “abandoned her.” Court records show that a week before her arrest, on Dec. 11, Devine and his wife requested the court “immediately rescind” the harassment prevention orders against Overstreet. By summer 2014, Devine wanted to end their relationship, and began receiving harassing and threatening messages, he told investigators.

2015

August, 2015 Rob Devine is featured in FBI LEEDA Insighter Magazine p32 – in 2015 Devine was paid $125,284 a year.

2015 – internal affairs investigation was ordered by the Chief to look into Devine actions and in July 2015 – Devine received a 60-day unpaid suspension after an internal affairs investigation found that he improperly ordered an investigation into Overstreet using department resources and technology.

July – December 2015

Robert Devine, was on paid administrative leave since July 2015. Devine, who made $122,695 in 2014, had been paid $121,625, as of December 10, 2015. His biweekly base salary is $3,659. will be reinstated as a patrolman following a 60-day unpaid suspension – a demotion that surprised two former police officers. Devine reached an agreement with Hartman to return to the lowest rank within the department.

As you may recall we Have been waiting to hear from HRD regarding any rights Robert Devine may have under Civil Service, We have recently learned that Civil Service has determined that Devine does have a valid leave of absence from his previous civil service position. From my perspective this development significantly alters the complexion of the situation. As I have indicated in our past conversations Ï am not willing to take the risk of having him return to the department into a command capacity therefore I have entered into an agreement to return him to the department as a patrolman following a sixty day suspension.

February 12, 2016 Devine was demoted by Town Manager Michael Hartman, who announced his decision in a brief press release. Devine reached an agreement with Hartman to return to the lowest rank within the department. Due to this decision in the case by Michael Hartman was one of the reasons Chief Shastany announced that he planed to retire in April, 2016.

I wish to correct some of the misinformation that has appeared in recent news accounts concerning the Police Chief’s resignation. The decision to resolve the situation involving former Deputy Chief Devine by allowing him to return to duty as a Patrol Officer following a lengthy unpaid suspension was a difficult one and not one that I arrived at without considering all the different points of view. To the extent that it has been suggested that the decision was made without any input from the Police Chief is completely false. Prior to any decision being made I held a meeting in my office with the Chief and Town Counsel during which the various possible options were discussed. While the Chief made very clear at that meeting what his preferred option was, I made clear to the Chief that depending on what Civil Service rights former Deputy Chief Devine still retained. there was a possibility that he may eventually be returned to duty. As the process unfolded, the Chief had conversations with myself and Town Counsel which he was updated on where things stood prior to any final agreement having been made. While the Chief continued to express his disagreement with approach I was taking, he was made aware of what was happening at the time. For anyone to suggest otherwise is simply not providing the full story. Letter

2019 Robert Devine writes a Recommendations for Improving Firearms Vetting in Massachusetts. In the same article, Devine thanks his family for helping and supporting him through the Law School.

Investigation into Sandra Birchmore Death:

Internal investigators found Facebook messages between Birchmore and Devine during which he asked her for sex acts and discussed locations to meet. Devine communicated with Birchmore on Facebook, using the alias Marty Riggs, a police officer from “Lethal Weapon.”

Devine had a sexual relationship with Sandra Birchmore while she was still a member of the Explorers Program, but, by 2020, he was having full-fledged sexual encounters with her at various locations, including inside his Stoughton P.D. patrol car.5 Defendant Devine’s relationship with Ms. Birchmore appears to have been ongoing at the time of her death.  Read here

2022 Devine resigned in 2022 following an internal affairs investigation that found he had an ‘inappropriate relationship’ with Sandra Birchmore and other young girls.

2024 His wife Lisa J. Devine is still employed by Quincy PD and is on the promotional list as a sergeant of Quincy PD.

Matthew Farwell told troopers he visited Birchmore’s apartment on the evening of Feb. 1, 2021, telling her that he wasn’t the father of her baby, records show. Birchmore was upset, Farwell told the troopers, but didn’t make “any suicidal statements.”

“Matt said that he was straightforward in his conversation with her, and told her that it was all over and he was blocking her from all forms of communication,” Fanning wrote.

May 2021, the state Office of the Chief Medical Examiner ruled that Birchmore, 23, a former participant in a Stoughton police youth program who was pregnant when she died: killed herself by hanging, according to her death certificate

2021 report, State Police Trooper Matthew Dunne described finding Birchmore’s body in her bedroom on Feb. 4, 2021.

  • He said he found no indications of physical abuse or bruising, swelling, external trauma, or markings suggesting a struggle, the report said. Chris Adams and Caitlyn Bulger of the Medical Examiner’s Office took custody of the body.
  • Swabs from Birchmore’s body, hair and fingernail clippings, and clothing she was wearing were taken for a sexual assault kit, was not tested.
Second Autopsy

Former NY City medical examiner Dr. Michael Baden in a June 18 letter to a lawyer for Birchmore’s estate wrote. 

  • “Ms. Birchmore did not die of suicidal hanging … The cause of Ms. Birchmore’s death is ‘Strangulation’ and the manner of death is ‘Homicide.’”
  • Baden said the extent of Birchmore’s injuries, as well as the placement of a ligature found on her body, were among the reasons for his determination.
  • He noted that Birchmore had suffered a fracture to a small U-shape bone in the neck, known as the hyoid bone, which fractures “rarely, if at all, in suicidal hanging” but does in “half of homicidal strangulation of women.”

As part of this investigation, the government retained Dr. William Smock as an expert to independently review the crime scene photos, autopsy photos, and the Medical Examiner’s autopsy report. Dr. Smock is an emergency medicine residency and forensic

The Medical Examiner’s autopsy report further confirmed that Birchmore was approximately 8 to 10 weeks pregnant at the time of her death. The autopsy included toxicology testing. The results of the toxicology tests were negative for all substances except for sertraline, which was likely explained by the antidepressants Birchmore had been prescribed.

Dr. Smock has made several observations and conclusions that call into question the prior finding that Birchmore’s cause of death was suicide and instead further confirm that Birchmore’s cause of death was homicide.

Upon entering the apartment, they located Birchmore apparently deceased, seated on the floor of the bedroom Canton Fire Dept. personnel responded. Birchmore was then determined to be deceased at approximately 11:46 AM by Firefighter/paramedic Daniel Whitley. Report

On Feb. 1, 2021, surveillance cameras captured Matthew Farwell arriving and then leaving Birchmore’s apartment building in Canton, and he was the last known person to see her alive, a Stoughton police internal affairs report said. Birchmore’s body was found there three days later. During an interview on Feb. 6, 2021 with State Police, Farwell gave an account of his encounter with Birchmore at her apartment five days earlier. September 23, 2022, Chief McNamara held a press conference with many media outlets in attendance. After extensive preparation, the Chief made a statement related to former members of the Stoughton Police Department who had been involved with the late Sandra Birchmore

Throughout your conversations with my client, and later with myself, you have indicated that you view him as a witness in your investigation. This is consistent with reality as Mr. Farewell has committed no crime. Like many, he is saddened by Ms. Birchmore’s death. During our recent conversations, you asked Mr. Farewell to submit a DNA sample and participate in a polygraph interview. Although I appreciate your diligence, I advised my client to decline these requests and the request for a further interview (not a polygraph) that accompanied them. Letter
