A New Mexico deputy has been charged with murder in connection with the fatal shooting of 17-year-old Elijah Hadley near Mescalero in June 2024. Deputy Jacob Diaz-Austin, 28, of the Otero County Sheriff’s’ Office, faces an open count of murder for his actions during the incident.
If convicted, Diaz-Austin could face a sentence of life in prison, along with five years of parole, according to the criminal complaint filed. He could also be convicted of second-degree murder and sentenced to up to 18 years of incarceration and two years of parole. A firearm enhancement could be added for using a gun while committing a felony, meaning another five years could be added to the prison term.

In a shocking series of events captured on video, Diaz-Austin fired 19 shots at Hadley. The footage has sparked widespread outrage and demands for justice from Hadley’s family and tribal community. Elijah’s family has described him as a kind and promising young man whose life was tragically cut short.
